By creating an account or using Click Rally (the "Service"), operated by Pixel Planet LLC d/b/a Click Rally ("we", "us"), you agree to these Terms of Use. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use Click Rally.
Click Rally is a marketplace that connects businesses ("Clients") that need photography, videography, or drone work with independent creators ("Creators").
We provide the platform only. We are not a party to any agreement for services between a Client and a Creator, we do not employ Creators, and we do not perform, supervise, or guarantee the work. Creators are independent contractors — not employees or agents of Click Rally or of any Client.
You are responsible for the accuracy of your information, for keeping your login secure, and for all activity under your account. Notify us immediately of any unauthorized use.
Payments are processed by Stripe, Inc. and are subject to Stripe’s terms. We do not store your full card or bank numbers.
When a Client books a Creator, the Client’s payment (the Creator’s payout plus our service fee) is charged and held in escrow. The Creator’s payout is released only after the Client reviews the delivered work and approves it. Our service fee is retained by Click Rally as compensation for operating the platform.
You are responsible for any taxes on amounts you earn or spend through the Service.
A Client may cancel a booked gig before approving the delivered work; the escrowed payment is refunded to the Client’s original payment method, and the Creator is released from the booking. Once a Client approves delivered work and payment is released, the transaction is final.
You retain ownership of the content you upload (profiles, portfolios, and delivered media). You grant Click Rally a limited license to host and display that content to operate the Service.
Rights to delivered work between a Client and a Creator are governed by their own agreement. You represent that you have the rights to everything you upload and that it does not infringe anyone’s rights or violate any law.
You agree not to: break the law; infringe others’ rights; post false, harmful, harassing, or infringing content; circumvent the platform to avoid fees; misuse other users’ data; or interfere with the Service’s operation or security.
Click Rally has ZERO TOLERANCE for objectionable content or abusive users. You agree not to post, upload, or transmit any content that is unlawful, obscene, pornographic, hateful, harassing, threatening, defamatory, or otherwise objectionable, and not to harass, threaten, or abuse any other user. This applies to every part of the Service, including profiles, portfolios, gig listings, messages, and delivered media.
You can report objectionable content or abusive users at any time using the in-app Report option, and you can block another user so their content is removed from your view instantly. We review reports and act within 24 hours — removing offending content and ejecting (banning) users who violate this policy. By creating an account or using the Service you agree to these rules; if you do not agree, do not use Click Rally.
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant the conduct, quality, safety, or legality of any user, Client, Creator, or work arranged through the Service.
To the fullest extent permitted by law, Click Rally is not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the Service will not exceed the greater of the fees we earned on the transaction at issue or US $100.
You agree to indemnify and hold harmless Click Rally from claims arising out of your use of the Service, your content, or your dealings with other users.
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws rules. You agree to resolve disputes in the state or federal courts located in Georgia, unless applicable law provides otherwise.
We may suspend or terminate accounts that violate these Terms. You may stop using the Service at any time.
We may update these Terms; material changes will be reflected by a new effective date, and continued use after an update means you accept the revised Terms.
